1. Scope

These terms of use apply to all users of the site fitundaktivblog.digital, operated by Joya Assessoria Contabil LTDA, Avenida Nova Cantareira, 1740, Sala 2, Sao Paulo/SP, Brazil, (hereinafter « the Provider »).

By accessing this site and using the content and services offered, the user declares acceptance of these terms of use. If the user does not accept these terms, they must refrain from using the site.

Deviating general terms and conditions of the user are not recognized, save with the Provider's express written agreement as to their application.

2. Formation of the contract

The presentation of products and content on the site does not constitute a legally binding offer, but a non-binding invitation to the user to place an order.

The contract is concluded as soon as the user completes the ordering process and receives the order confirmation by e-mail. By completing the order, the user firmly declares that they are making an offer to acquire the selected product.

The Provider reserves the right to refuse an order without having to state reasons, in particular where abusive use or a breach of these terms of use is suspected.

3. Prices and payment

The price of the digital product is $49.00 all taxes included, where applicable. All prices are understood as final prices.

The following means of payment are accepted:

Payment is due immediately upon ordering. Access to the digital product is granted only after payment has been received in full.

4. Delivery of digital products

The product offered is a digital product in PDF format. Delivery takes place immediately after receipt of payment, by making available a download link sent by e-mail to the address indicated by the user.

It is the user's responsibility to indicate a valid e-mail address and to ensure that delivery of the message is not prevented by a spam filter or a similar technical setting.

If the user does not receive the download link, they are invited to contact the Provider within 14 days of purchase at the address [email protected] .

5. Copyright

All content on this site — including texts, graphics, images, layouts, logos, and downloadable files — is protected by copyright and belongs to the Provider or to the rights holders concerned.

The digital product acquired may be used only for the buyer's personal, non-commercial use. Any form of reproduction, distribution, making available to the public, transmission to third parties, or commercial exploitation — in whole or in part — is prohibited without the Provider's prior written agreement.

Infringements of copyright may entail civil and criminal consequences.

6. Exclusion of liability

The information made available on this site and in the products offered serves exclusively for general education and information. It constitutes no medical, therapeutic, or health advice and in no case replaces consultation with a physician, a therapist, or any other qualified health professional.

The Provider declines all responsibility for health decisions taken on the basis of the content made available. The user applies this information at their own risk.

The Provider is not liable for damages resulting from the use or unavailability of the site or of the digital products, to the extent permitted by law. This covers in particular indirect damages, lost profits, and data loss.

The limitation of liability does not apply in cases of intentional fault, gross negligence, or breach of an essential contractual obligation.

7. Right of withdrawal

Consumers have a statutory right of withdrawal. You will find all the information relating to the right of withdrawal, including the period, the conditions, and the model withdrawal form, in our Right of Withdrawal.

Please note that the right of withdrawal relating to digital content may expire early under certain conditions, in particular where performance of the contract has begun and the consumer has expressly consented to it.

8. Dispute resolution

The European Commission provides an online dispute resolution (ODR) platform, accessible at the following link: https://ec.europa.eu/consumers/odr/

Our e-mail address appears above in the legal notice as well as at the address: [email protected]

We are neither willing nor obliged to participate in a dispute resolution procedure before a consumer mediation body.

9. Applicable law

All legal relations between the Provider and the user are governed by French law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

With respect to consumers, this choice of law applies only insofar as it does not deprive the consumer of the protection afforded by the mandatory provisions of the law of the state in which they have their habitual residence.

10. Severability clause

If individual provisions of these terms of use were or were to become void or unenforceable after the conclusion of the contract, the validity of the other provisions would not be affected.

The void or unenforceable provision shall be replaced by the valid and enforceable provision whose effects come closest to the economic objective pursued by the parties by means of the void or unenforceable provision.

11. Modification of the terms of use

The Provider reserves the right to modify these terms of use at any time and without particular notification. The version in force is available on the site. The applicable version is the one in force at the time of the order.

Users are advised to review the terms of use regularly in order to be aware of any modifications.
